According to a report from CNN, a bid by allies of former President Donald Trump to get a defamation suit filed against them by a former Dominion Voting Systems executive dismissed was shot down by a Colorado judge on Friday.

The report notes that Eric Coomer was accused by lawyers Sidney Powell and Rudy Giuliani — among others — of involvement in a plot to rig the 2020 election against Donald Trump.

CNN’s TierneySneed reports that District Judge Marie Avery Moses has ruled that the trial can proceed and that further “extensive discovery” can be made.

Moses stated in the ruling that false statements of facts or deliberate dissemination of dangerous and inflamatory political disinformation to create distrust in democratic institutions have no constitutional value. Public has an active interest to ensure that defamatory statements are addressed. “

She said, “There are evidence that Giuliani‚Äôs allegations against Coomer conformed a preconceived storyline about fraud given his claims of fraud after the election. There is also evidence that Giuliani had an incentive to discredit Coomer in order to support former President Trump as well as to keep national attention. These facts support the conclusion of actual malice. “
